Issuing of A1 certificates for persons working/engaged in activities in a number of EU countries

What is A1 and what is it needed for?

A1 is a document proving that the person in Lithuania is insured in social security and in another state in which he/she will carry out the self-employed activity or to work on the basis of a contract of employment will not have to pay contributions to this insurance.

This certificate is required for persons carrying out self-employed activities in Lithuania abroad or for persons working in more than one EU country.

This certificate must be applied to “Sodra” by the person itself.

What documents on the A1 certificate must be submitted by the person?

A self-employed person who is leaving for activities (to carry out work related to it) must attach to a specified form:

  • a request for a certificate of application of the Law of the Republic of Lithuania on the application of social insurance legislation to a self-employed person engaged in activities in a foreign country;
  • documents proving the activities of a self-employed person in Lithuania and abroad: copies of contracts concluded with natural or legal persons for the performance of activities in Lithuania with a certified copy of a contract concluded by a state enterprise of a receiving state (another entity), provided that the person carrying out the self-employed activity is not the taxpayer of value added tax – certified copies of the invoices;
  • a certified copy of the personal document (if the self-employed person is not a citizen of the Republic of Lithuania).

 

In Lithuania and in another EU Member State, EEA State or Switzerland, an employed and/or self-employed person simultaneously has to accompany an application in the prescribed form:

  • the application for a certificate on the application of social security legislation to a person employed under an employment contract and/or self-employed activity in two or more Member States;
  • a certified copy of the personal document (if a person is not a citizen of the Republic of Lithuania);
  • copies of contracts concluded in Lithuania and another EU Member State, an EEA State or Switzerland;
  • the execution of self-employed activities in Lithuania and another EU Member State, in an EEA State or in Switzerland (concluded (ongoing) contracts relating to self-employed activities, other documents).

 

  Copies of the documents shall be certified and quality and easily readable.

The application and other documents (scanned copies) may be submitted:

  • after joining the personal account of the “Sodra”;
  • after joining the e-policyholder service system; 
  • by post, to Kalvarija 147, Vilnius Foreign Benefits Service;
  • upon arrival at any convenient host of “Sodra”.

How long will a certificate decision be submitted?

The Foreign Benefit Service is to take a decision on the issue of A1 certificates within 20 working days of receiving all the documents.

  When the person so wishes, a certificate shall be issued confirming the fact that the A1 procedure has already been started but has not been completed yet.

 

A free text application for the issue of this certificate may be submitted:

  • after joining the personal account of the “Sodra”;
  • after joining the e-policyholder service system; 
  • by post, to Kalvarija 147, Vilnius Foreign Benefits Service;
  • upon arrival at any convenient host of “Sodra”.

Does a person carrying out self-employed activities or working under a contract of employment in several EU countries have to have an A1 certificate?

A person carrying out self-employed activities or working under a contract of employment in a number of EU countries must be interested in what arrangements for A1 certificates are valid in the State or States where the work will take place. One Member State shall require such persons to provide the original of the certificate, other documents which are sufficient, and other documents which may be provided by the person's representative at a distance.

In which cases is the person to return issued A1 certificates?

A person shall inform the Foreign Benefits Service within 5 working days and return  the A1 certificate if:

  • terminate employment contracts with one or more undertakings;
  • a person is starting to work or pursue a self-employed activity in another Member State;
  • a person takes employment in another undertaking;
  • the residence permit or visa D shall be withdrawn.


A person working simultaneously in Lithuania and another Member State must return to the Foreign Benefits Service an A1 certificate within 5 working days if the duration of the person's non-insurance periods exceeds one fifth of the total period of work in two or more Member States.

In which cases can a person arriving from an EU country be able to pay no contributions in Lithuania?

A citizen of an EU Member State, an EEA Member State or a Swiss Confederation who carries out self-employed activities in Lithuania:

  • exempt from payment of VSD contributions in Lithuania,  provides to the “Sodra” the original of the A1 certificate. A person from the activity in Lithuania will have to pay taxes in the country where the A1 certificate was issued.
  • not exempt from VSD contributions in Lithuania if it fails to provide evidence that it works in another EU state (A1 certificate). This person is subject to Lithuanian legislation regulating the payment of taxes.
