I would like to claim an unemployment benefit

If you lose your job, you must contact the Employment Service – only after you have registered with the Employment Service and obtained unemployment status, you will be able to apply for unemployment insurance benefits.

 

You can apply for unemployment benefit:

  • to the employment service;
  • in your personal "Sodra" account for resident when opting for application for unemployment benefit;
  • upon arrival at the "Sodra" department. You must have:
    • proof of identity, such as: passport, identity card, permanent residence permit in Lithuania;
    • also know the details of the personal account into which the benefit will be paid.

 

If you submit your claim to the Employment Service, it will forward the data to “Sodra” upon receipt of your claim for unemployment benefit, which will provide you with the benefit.

Important! If a resident has lost his/her job or has been removed from the Employment Service and does not pay compulsory health insurance contributions, then the person is obliged to pay CHI contributions independently. Read more about CHI self-contribution here.

You can entitled to receive the unemployment benefit if:

  • You have been insured by unemployment insurance, i.e. you have been working and you personally paid the unemployment social insurance contributions or they were paid for you;
  • You are registered at your employment service​.
  • You are provided with an unemployed person’s status at the decision of the employment service.
  • The employment service did not offer you proper employment or active labour market policy measures.
  • During the last 30 months prior to registering at the employment service, you had at least a 12 months unemployment insurance record.
  • You have finished the primary military service or an alternative national defence service, during which you received the primary military readiness level and registered at the employment service not later than in 6 months since your release from the service.

Individuals registered with the Employment Service, who, at the decision of this service, are given the status of an unemployed person shall be entitled to unemployment benefit if, within the last 30 months before the date of registration with the Employment Service, they have completed the length of service of unemployment insurance period of at least 12 months. When unemployment benefit is granted to an individual who has worked abroad, then the length of service of unemployment insurance, that has been completed by the individual both in Lithuania and, under certain conditions, abroad, shall be included in the length of service of unemployment insurance. The duration of the unemployment benefit that was paid abroad, the date of the end of its payment and the date of registration with the Lithuanian Employment Service shall be also assessed.

 

For individuals who return from the EU

Unemployment benefits shall be granted to individuals, who have worked in the Member States of the European Union (EU), Norway, Iceland, Liechtenstein or the Swiss Confederation (hereinafter - the Member States) and who, as required by the national legal acts of that Member State, have been covered by unemployment insurance, applying not only the Law on Unemployment Social Insurance and the Regulations of Unemployment Social Insurance benefits, but also the European Union regulations on the coordination of social security systems, which enshrine the basic rule stipulating that unemployment benefits shall be granted by the competent State (the State of the last place of work), and the length of service of unemployment insurance, that has been completed in other EU Member States, shall be summed up if the last period of unemployment insurance has been completed in Lithuania (but there are also exemptions).

The Description of the Procedure for the implementation of the provisions of the European Union regulations on the coordination of social security systems, related to the retention of entitlement to unemployment social insurance benefits and the aggregation of insurance periods, that has been approved by the Order No A1-921 of the Minister of Social Security and Labour of the Republic of Lithuania of 20 December 2021, shall be also followed.

 

If you have been granted unemployment benefit by the competent authority of the Member State in which your last period of unemployment insurance has been completed, after your return to Lithuania and registration with the Employment Service (within the time limit specified in the U2 document issued by the competent authority of the other State), the unemployment benefit will continue to be paid (exported) by the Member State that has granted it (usually exports for 3 months). The unemployment benefit, that has been granted in Lithuania under the legal acts of Lithuania, will be paid only for a period exceeding the duration of the unemployment benefit that has been paid by another Member State. In this case, the following will be done in granting unemployment benefit in Lithuania:

  • periods of unemployment insurance, that have been completed in the Member State, shall be aggregated, without requiring the last period of unemployment insurance in Lithuania;
  • the income that the individual had in another Member State shall be also assessed at the time of calculating the benefit.

 

If you have not exercised the right to receive unemployment benefit in the Member State, in which your last period of unemployment insurance has been completed, and you have returned to Lithuania and have registered with the Employment Service and have submitted request for unemployment benefit, the benefit will be granted under the legal acts of Lithuania. In this case:

  • the periods of unemployment insurance, that have been completed in another Member State, will be aggregated if the last period of unemployment insurance will be completed in Lithuania (the last unemployment insurance (the employment or insurance coverage at the State expense) must be in Lithuania);
  • the benefit will be calculated only on the basis of the income that the individual had in Lithuania (the income that the individual had in another Member State shall not be assessed).

However, if during the period of the last employment you lived in or retained your place of residence in Lithuania (during the period of the last employment in another Member State you have retained the place of residence (centre of interests) in Lithuania; have worked as a frontier worker in another Member State, have been employed as a seasonal worker or as a temporary worker, have worked under a fixed-term contract, etc.), the following will be done in granting unemployment benefit:

  • periods of unemployment insurance, that have been completed in the Member State, will be aggregated, without requiring the last period of unemployment insurance in Lithuania;
  • the benefit will be calculated by assessing the income that has been received in another Member State.

 

The documents confirming the periods of unemployment insurance, that have been completed in the EU Member States, and the income that the individual had must be submitted to establish the entitlement to unemployment benefit in Lithuania. The PD U1 document or a structured electronic document (hereinafter - the SED) U002, issued by the competent authorities of the Member States, prove (confirm) the periods of unemployment insurance (employment) that have been completed in those Member States. The income, that the individual had in another Member State, are confirmed by the SED U004 document issued by the competent authorities of those Member States.

The SED U002 and U004 documents are issued at the request of the competent authorities of the Member States. Therefore, you must contact the Department of "Sodra" for the receipt of these SED documents or submit, after having logged in to the personal Sodra account for the resident, the Request for mediation in obtaining the confirmation of the periods of unemployment social insurance and employment activities, that have been completed in another Member State.

For individuals who return from the United Kingdom

In granting unemployment benefit for returnees from the United Kingdom (hereinafter - the UK), it is necessary to determine whether the individual falls within the scope of the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (hereinafter – the Withdrawal Agreement). The Withdrawal Agreement shall apply to individuals if they meet at least one of these conditions:

  • at the end of the transition period (until 31 December 2020) and after the end of the transition period, the individual was, without interruption*, in one of the situations referred to in Article 30(1) of this Agreement, which simultaneously covers both the Member State - Lithuania and the UK;

* The EU Member States and the UK have agreed that, in applying the Withdrawal Agreement, the concept ‘without interruption’ shall be understood as a period not exceeding 30 days. Therefore, if:

  • you have not declared the fact of leaving Lithuania, the 30-day period shall be calculated from the next day following the end of the employment relationship in the UK until the date of registration with the Lithuanian Employment Service;
  • you have declared the fact of leaving Lithuania, the 30-day period shall be calculated from the date of declaring the return to Lithuania in the Population Register of the Republic of Lithuania until the date of registration with the Lithuanian Employment Service.

 

If you have registered with the Employment Service:

  • within 30 days of the end of employment in the UK or from the declaration of the place of residence in the Population Register of the Republic of Lithuanian, or you have settled or pre-settled status in the UK, the following will be done in granting unemployment benefit:
    • periods of unemployment insurance, that have been completed in the UK, will be aggregated, without requiring the last period of unemployment insurance in Lithuania;
    • the benefit will be calculated by assessing the income that the individual had in the UK.
  • later than within 30 days of the end of employment in the UK or from the date of declaration of the place of residence in Lithuania, and you do not have settled or pre-settled status in the UK, the following will be done in granting unemployment benefit:
    • periods of unemployment insurance, that have been completed in the UK, will be aggregated only if the last period of unemployment insurance will be completed in Lithuania (after the return from the UK, the last employment or insurance coverage at the State expense must be in Lithuania);
    • the benefit will be calculated only on the basis of the income that the individual had in Lithuania (the income that the individual had in the UK shall not be assessed).

 

You have to print out the document about the valid settled or pre-settled status, that has been granted to you, from the website of the UK Migration Service, and you may submit it to "Sodra" Department:

  • after having logged in to the personal Sodra account for the resident, by submitting a general request, or together with the Request for mediation in obtaining the confirmation of the periods of unemployment social insurance and employment activities, that have been completed in the UK;
  • deliver to Sodra Department;
  • send by post (a copy of a personal identity document certified in accordance with the procedure established by law (for example, by the Notary Public) must be enclosed).

 

If the provisions of the Withdrawal Agreement do not apply to you (you went to work in the UK after 31 December 2020 and do not have a valid settled or pre-settled status in the UK granted to you), you will be granted unemployment benefit in accordance with the Protocol on Social Security Coordination of the EU-UK Cooperation and Trade Agreement: in granting unemployment benefit, the periods of unemployment insurance, that have been completed in the UK, will be aggregated only if the last period of unemployment insurance will be completed in Lithuania. The amount of unemployment benefit will be calculated only on the basis of insured income that the individual had in Lithuania.

It should be noted that if you have been granted unemployment benefit in the UK (unemployment benefits are granted by the competent authority of the country whose legal acts have been lately applicable to the individual), in granting unemployment benefit in Lithuania, the duration of the unemployment benefit that has been paid in the UK, the end date of its payment and the date of registration with the Lithuanian Employment Service will be assessed.

If you have worked in one or more Member States of the European Union, Norway, Iceland, Liechtenstein, United Kingdom or the Swiss Confederation, and do not have a document certifying unemployment insurance qualifying period (U1 document issued abroad), you can contact any "Sodra" department for mediation in certifying unemployment insurance qualifying period completed abroad, and submit an application for mediation regarding certification of periods of unemployment social insurance and periods of employment completed in another Member State.

You can also submit this application by logging in to your personal "Sodra" account for residents and selecting the application for mediation regarding certification of periods of unemployment social insurance and periods of employment completed in another Member State. 

When applying to a "Sodra" department, you need to have an identity document and documents that contain data about your work abroad (a copy of the employment contract, etc.). In such case, the "Sodra" department will contact the competent authority of the foreign state within 7 working days from the date of receipt of your application regarding the receipt of data on the unemployment insurance period completed abroad, and upon receipt of a response from abroad it will inform you about this in the manner indicated in your application. 


 

If you have worked in Lithuania and want to receive a document proving the period of unemployment insurance in Lithuania (U1 document), you must submit an application to issue a U1 document confirming the periods of unemployment social insurance and employment completed in Lithuania. You can do this: 

  • by coming directly to a "Sodra" department;  
  • by logging in to your personal "Sodra" account for residents and submitting an application to issue a U1 document confirming the periods of unemployment social insurance and employment completed in Lithuania. 

 

U1 document is issued within 5 working days from the date of receipt of your application at a "Sodra" department. When the U1 document is issued to you personally, you must have an identity document to collect it.  

When the U1 document is collected by an authorized person, that person must present a certified power of attorney along with the identity document.  

If you are not collecting the U1 document in person or through an authorized person, at your request, U1 document can be sent to the competent authority of the EU Member State referred to in your application, at the address indicated by you.

The unemployment benefit consists of two parts - fixed and variable:

A fixed part of the unemployment benefit is equal to 149,39€, i.e. 23.27% of the minimum monthly wages (hereinafter – the MMW) that is valid in the month for which the benefit is paid

The variable part depends on the income you had. In calculating the variable part of the unemployment benefit, your insured income that you had during 30 months that have elapsed before the end of the calendar month that was before the previous calendar month from the date on which the unemployed person was registered with the Employment Service (hereinafter - the ES) is considered.

The variable monthly part of the benefit by months of payment:

In the first to third month of payment of the unemployment benefit – 38.79% of the average insured income of the person.

In the fourth to sixth month – 31.03%.

In the seventh to ninth month – 23.27%.

 

The example of calculating the unemployment benefit

Suppose that in January 2021, a person has registered with the ES as an unemployed person.

Fixed part

642€ x 23.27% = 149.39€

Variable part is calculated on the basis of the average monthly insured income of the person, which is determined on the basis of the insured income that the person had in the period from 1 June 2018 to 30 November 2020. Suppose that the average monthly insured income of this person is 800€.

In the 1st to 3rd month of the payment of the unemployment benefit – 800 x 38.79% = 310.32€;

In the 4th to 6th month – 800 x 31.03% = 248.24€;

In the 7th to 9th month – 800 x 23.27% = 186.16€.

 

The unemployment benefit is equal to:

In January to March – 149.39€ + 310.32€ = 459.71€;

In April to June – 149.39€ + 248.24€ = 397.63€;

In July to September – 149.39€ + 186.16€ = 335.55€.

The unemployment benefit for incomplete month is calculated on the basis of the calendar days of the month for which it is paid.

 

The maximum amounts

The maximum unemployment benefit cannot exceed 58.18% of the national average monthly wages published by the Lithuanian Department of Statistics (including wage data of individual enterprises), that was valid in the calendar quarter that was before the previous calendar quarter from the date of registration with the ES.

The maximum unemployment benefit for persons having registered with the ES in the 2nd quarter of 2021 (from 1 April 2021 to 30 June 2021) is 879,86€ (1512.30€ x 58.18% = 879,86€).

The maximum unemployment benefit for persons having registered with the ES in the 3rd quarter of 2021 (from 1 July 2021 to 30 September 2021) is 876,13€ (1505.90€ x 58.18% = 876,13€).

The maximum unemployment benefit for persons having registered with the ES in the 4th quarter of 2021 (from 1 October 2021 to 31 December 2021) is 904,35€ (1554,40€ x 58.18% = 904,35€).

 

When paying unemployment benefit for the period after 01/07/2021 and if you receive:

  • a state pension;
  • annuity paid to a former athlete;
  • compensatory allowance paid to a creative employee of professional performing arts institutions;
  • sickness benefit due to an accident at work and an occupational disease, and professional rehabilitation, sickness, maternity, paternity or childcare benefit

You will only be paid a portion of the unemployment benefit that exceeds the amount of pensions, compensations, annuities or benefits you receive. Pensions or benefits received for other persons shall not be deducted from unemployment benefits.

In the 7th to 9th month – 800 x 23.27% = 186.16€.

 

The unemployment benefit is equal to:

In January to March – 169.87€ + 310.32€ = 480.19€;

In April to June – 169.87€ + 248.24€ = 418.11€;

In July to September – 169.87€ + 186.16€ = 356.03€.

The unemployment benefit for incomplete month is calculated on the basis of the calendar days of the month for which it is paid.

 

The maximum amounts

The maximum unemployment benefit cannot exceed 58.18% of the national average monthly wages published by the Lithuanian Department of Statistics (including wage data of individual enterprises), that was valid in the calendar quarter that was before the previous calendar quarter from the date of registration with the ES.

The maximum unemployment benefit for persons having registered with the ES in the 1ST quarter of 2022 (from 1 January 2022 to 31 March 2022) is 922.73€ (1512.30€ x 58.18% = 922.73€).

 

When paying unemployment benefit for the period after 01/07/2021 and if you receive:

  • a state pension;
  • annuity paid to a former athlete;
  • compensatory allowance paid to a creative employee of professional performing arts institutions;
  • sickness benefit due to an accident at work and an occupational disease, and professional rehabilitation, sickness, maternity, paternity or childcare benefit

You will only be paid a portion of the unemployment benefit that exceeds the amount of pensions, compensations, annuities or benefits you receive. Pensions or benefits received for other persons shall not be deducted from unemployment benefits.

The unemployment benefit payment begins from the 8th day after the date of the registration at the Employment Service, except:

  • when you are dismissed from work (service) due to your fault, the unemployment benefit payment begins after 3 months from the date of the registration at the Employment Service;
  • when you receive sick pay, occupational rehabilitation, maternity, paternity, childcare allowance or sick pay  for occupational accidents and occupational diseases awarded before the date of the registration at the Employment Service, the unemployment benefit payment begins after the expiration date of these benefits.

   If you have previously received an unemployment benefit, a re-unemployment benefit may be assigned only after 12 months from the date of termination of the previous unemployment benefit (after the full payment of the unemployment benefit) by re-registering at the Employment Service and applying for an unemployment benefit.

The amount of unemployment benefit is transferred to your personal account. 

  If you want to change the account to which the unemployment benefit is paid or you have not yet submitted it, you can do so by logging into your personal "Sodra" account for the resident and selecting a request to change the unemployment social security benefit payment in the application section, GPS14.

Unemployment benefits shall be paid for the previous month not earlier than 20 of the month and not later than the last day of the month.

The unemployment benefit is paid for 9 months.

The payment of the unemployment benefit can be prolonged in the following cases:

  • For 2 months, in case at the day of the end of unemployment benefit payment term you will have no more than 5 years until old-age pension age and you are not provided with a preliminary retirement pension.
  • Up to 30 days, if you got sick or suffered a trauma, while receiving the unemployment benefit and therefore temporarily lost your capacity for work. The payment of the unemployment benefit is prolonged for the number of days you were sick, but for no longer than 30 days. This rule does not apply if you got sick or suffered a trauma while performing an illegal (criminal) activity, due to being under the influence of alcohol or misused psychotropic substances, damaged your health by yourself or played sick.
  • The duration of payment of unemployment benefits for unemployed persons who voluntarily treat pathological gambling, substance use disorder in personal health care institutions providing inpatient treatment for addictive illnesses shall be extended for a maximum of 28 calendar days once per calendar year (the total duration of payment for unemployment benefits due to sick leave may not exceed 30 days).

  The duration of payment shall not be extended if you have injured yourself, pretended to be ill, fall ill or experienced trauma during a criminal offense, due to drunkenness or abuse of psychoactive substances, except for the unemployed who voluntarily treat pathological gambling, substance use disorder in personal health care institutions providing inpatient treatment for addictive illnesses.

  • For a pregnancy and childbirth leave period, if you were issued with a pregnancy and childbirth leave certificate while you were receiving the unemployment benefit.

 

  The unemployment benefit is paid during the period of validity of the unemployed status. When unemployed status is terminated (cancelled) or suspended, the unemployment benefit is also terminated or suspended.

  In case the recipient of the unemployment benefit dies, the benefit belonging to him until the day of his death is paid out to his inheritor, providing inheritance documents.

The unemployment benefit payments are paid only to the persons having the unemployed person’s status (this status is granted by the decision of the employment service), therefore, the payment of this benefit is terminated, suspended and resumed whenever information is received from the employment service regarding the termination, suspension, resuming or granting of the person’s unemployed  status.

 

  • The payment of cancelled unemployment benefit may be resumed if the status of unemployed person was withdrawn from a person in accordance with sub-paragraphs 1, 2, 4 and 13 of paragraph 4 of article 24 of the Law on Employment.

For example, you were employed or self-employed, and you quit before 6 months.

The payment of the terminated unemployment benefit shall be resumed only if the person re-enrolls with the Employment Service within 6 months of the termination of the unemployment benefit payment. The payment of unemployment benefit shall be resumed from the date of granting of unemployment status. The renewal of the suspension of unemployment benefit may be applied twice (persons who have received unemployment benefit before the entry into force of amendments to Article 11 of the Law on Unemployment Social Insurance 2021-06-16 may resume the payment of unemployment benefit for a second time if the payment has already been renewed once before that date and the second granting of unemployment status is already after that date, irrespective of the second termination of unemployment status – before or after the entry into force of the said Law).

  • If the status of unemployed person is suspended, the payment of unemployment benefit is also suspended (the status of unemployed person is suspended in the cases described in paragraph 1 of article 24 of the Law on Employment

​For example, for the period, when time-defined employment relations are started for a period not exceeding 6 months or the unemployed person becomes self-employed for a period not exceeding 6 months, a person takes part in the tools of support to learning and supportive employment, performs compulsory initial military service, or the unemployed person, who is a military volunteer, other active reserve military or prepared reserve military, is summoned for exercises, training or official tasks and receives remuneration for the days of service). When the status of unemployed person is resumed after suspension, the payment of cancelled unemployment benefit is resumed (continued). In such a case, the number of resumed payments of unemployment benefit shall be unlimited.

  • If you were previously paid an unemployment benefit, you may receive a re-unemployment benefit after re-registering with the Employment Service and applying for unemployment benefit only 12 months after the end of the previous unemployment benefit.

If the fact of illegal employment is established, the person must refund the unemployment benefit for the period of illegal employment, unless the person working illegally has notified at least one of the institutions exercising control of illegal employment

Who is entitled to a job search allowance?

From 1 January 2021, persons who meet the following conditions shall be eligible for job search allowance: 

  • the person has been granted unemployment status; 
  • the unemployed person does not participate in active labour market policy measures during his application for job search benefits to the Employment Service and the decision on granting this benefit; 
  • a person’s employment contract or legal relations equivalent to employment relationships , or or his self-employment has been de-registered expired not earlier than 3 months prior to the emergency or quarantine declared by the Government of the Republic of Lithuania;  
  • a person shall not be entitled to unemployment social insurance benefit or the period of payment thereof has expired at the time of the person’s application to the Employment Service.

 

Duration of payment of the benefit 

The job search allowance will be paid for the entire quarantine period and for a further 1 month after it ends.

 

Amount of job search benefit

  • The amount of job search allowance is 33 % the MMA in force in the month for which the job search allowance is paid. 
  • Job search allowance is EUR 211.86 per month (EUR 642 x 33 %) since January 2021. = EUR 211,86).
