I would like to claim an unemployment benefit

If you lose your job, you must contact the Employment Service – only after you have registered with the Employment Service and obtained unemployment status, you will be able to apply for unemployment insurance benefits.

 

You can apply for unemployment benefit:

  • to the employment service;
  • in your personal Sodra account for resident when opting for application for unemployment benefit, GPS18;
  • upon arrival at the Sodra unit. You must have:
    • proof of identity, such as: passport, identity card, permanent residence permit in Lithuania;
    • also know the details of the personal account into which the benefit will be paid.

 

If you submit your claim to the Employment Service, it will forward the data to “Sodrai” upon receipt of your claim for unemployment benefit, which will provide you with the benefit.

Important! If a resident has lost his/her job or has been removed from the Employment Service and does not pay compulsory health insurance contributions, then the person is obliged to pay CHI contributions independently. Read more about CHI self-contribution here.

You can entitled to receive the unemployment benefit if:

  • You have been insured by unemployment insurance, i.e. you have been working and you personally paid the unemployment social insurance contributions or they were paid for you;
  • You are registered at your employment service​.
  • You are provided with an unemployed person’s status at the decision of the employment service.
  • The employment service did not offer you proper employment or active labour market policy measures.
  • During the last 30 months prior to registering at the employment service, you had at least a 12 months unemployment insurance record.
  • You have finished the primary military service or an alternative national defence service, during which you received the primary military readiness level and registered at the employment service not later than in 6 months since your release from the service.

  • Application (lithuanian) for unemployment benefit, which you can submit:
    • to the employment service;
    • in your personal Sodra account for resident when opting for application for unemployment benefit, GPS18;
    • upon arrival at the Sodra unit.
  • A personal identification document (passport, personal identification card).

If you have worked in one or more Member States of the European Union, Norway, Iceland, Liechtenstein or the Swiss Confederation, and do not have a document certifying unemployment insurance qualifying period (U1 document issued abroad), you can contact any "Sodra" department for mediation in certifying unemployment insurance qualifying period completed abroad, and submit an application for mediation regarding certification of periods of unemployment social insurance and periods of employment completed in another Member State.

You can also submit this application by logging in to your personal "Sodra" account for residents and selecting the application for mediation regarding certification of periods of unemployment social insurance and periods of employment completed in another Member State, GDR8. 

When applying to a "Sodra" department, you need to have an identity document and documents that contain data about your work abroad (a copy of the employment contract, etc.). In such case, the "Sodra" department will contact the competent authority of the foreign state within 5 working days from the date of receipt of your application regarding the receipt of data on the unemployment insurance period completed abroad, and upon receipt of a response from abroad it will inform you about this in the manner indicated in your application. 


 

If you have worked in Lithuania and want to receive a document proving the period of unemployment insurance in Lithuania (U1 document), you must submit an application to issue a U1 document confirming the periods of unemployment social insurance and employment completed in Lithuania. You can do this: 

  • by coming directly to a "Sodra" department;  
  • by logging in to your personal "Sodra" account for residents and submitting an application to issue a U1 document confirming the periods of unemployment social insurance and employment completed in Lithuania, GPZ1. 

 

U1 document is issued within 5 working days from the date of receipt of your application at a "Sodra" department. When the U1 document is issued to you personally, you must have an identity document to collect it.  

When the U1 document is collected by an authorized person, that person must present a certified power of attorney along with the identity document.  

If you are not collecting the U1 document in person or through an authorized person, at your request, U1 document can be sent to the competent authority of the EU Member State referred to in your application, at the address indicated by you.

Unemployment benefit consists of two parts – constant and variable:

  1. The constant part of the unemployment benefit is equal to 141,25 Eur, i. e. 23,27% of the minimum monthly salary valid during the month in which the benefit is paid (607 x 23,27% = 141,25 Eur).
  2. The variable part depends on your income. During the calculation of the variable part of the unemployment benefit, your insured income received during the 30 months preceding the end of the calendar month before the last, from the date of the unemployed person’s registration at the Employment Service, should be assessed.

Variable monthly benefit part based on payment months:

  1. From the first to the third month of unemployment benefit payment – 38,79% of personal average insured income;
  2. From the fourth to the sixth month – 31,03% of personal average insured income;
  3. From the seventh to the ninth month – 23,27% of personal average insured income.

 

Persons registered in the Employment Service:

  • in 2020 1st quarter, the maximum unemployment benefit is 760,01 Eur (1306,30 x 0,5818);
  • in 2020 2nd quarter - 783,51 Eur (1346,70 x 0,5818);
  • in 2020 3rd quarter - 797,18 Eur (1370,20 x 0,5818);
  • in 2020 4th quarter - 807,31 Eur (1387,60 x 0,5818).


If you receive your own social security pension, asocial assistance, state pension, former athletes benefit, compensation for creative staff of professional performing arts institutions, as well as periodic compensation for the lost capacity for work or sickness benefit for accidents at work and occupational diseases, as well as sickness, maternity, paternity or childcare social security benefits, vocational rehabilitation benefits, only part of the unemployment benefit will be paid out of unemployment insurance funds in excess of the amount of pensions, compensations, rents or benefits received. Such pensions or benefits as orphan's pension shall not be deducted from unemployment benefits.

The unemployment benefit payment begins from the 8th day after the date of the registration at the Employment Service, except:

  • when you are dismissed from work (service) due to your fault, the unemployment benefit payment begins after 3 months from the date of the registration at the Employment Service;
  • when you receive sick pay, occupational rehabilitation, maternity, paternity, childcare allowance or sick pay  for occupational accidents and occupational diseases awarded before the date of the registration at the Employment Service, the unemployment benefit payment begins after the expiration date of these benefits.

   If you have previously received an unemployment benefit, a re-unemployment benefit may be assigned only after 12 months from the date of termination of the previous unemployment benefit (after the full payment of the unemployment benefit) by re-registering at the Employment Service and applying for an unemployment benefit.

The amount of unemployment benefit is transferred to your personal account. 

  If you want to change the account to which the unemployment benefit is paid or you have not yet submitted it, you can do so by logging into your personal "Sodra" account for the resident and selecting a request to change the unemployment social security benefit payment in the application section, GPS14.

Unemployment benefits shall be paid for the previous month not earlier than 20 of the month and not later than the last day of the month.

The unemployment benefit is paid for 9 months.

The payment of the unemployment benefit can be prolonged in the following cases:

  • For 2 months, in case at the day of the end of unemployment benefit payment term you will have no more than 5 years until old-age pension age and you are not provided with a preliminary retirement pension.
  • Up to 30 days, if you got sick or suffered a trauma, while receiving the unemployment benefit and therefore temporarily lost your capacity for work. The payment of the unemployment benefit is prolonged for the number of days you were sick, but for no longer than 30 days. This rule does not apply if you got sick or suffered a trauma while performing an illegal (criminal) activity, due to being under the influence of alcohol or misused psychotropic substances, damaged your health by yourself or played sick.
  • The duration of payment of unemployment benefits for unemployed persons who voluntarily treat pathological gambling, substance use disorder in personal health care institutions providing inpatient treatment for addictive illnesses shall be extended for a maximum of 28 calendar days once per calendar year (the total duration of payment for unemployment benefits due to sick leave may not exceed 30 days).

  The duration of payment shall not be extended if you have injured yourself, pretended to be ill, fall ill or experienced trauma during a criminal offense, due to drunkenness or abuse of psychoactive substances, except for the unemployed who voluntarily treat pathological gambling, substance use disorder in personal health care institutions providing inpatient treatment for addictive illnesses.

  • For a pregnancy and childbirth leave period, if you were issued with a pregnancy and childbirth leave certificate while you were receiving the unemployment benefit.

 

  The unemployment benefit is paid during the period of validity of the unemployed status. When unemployed status is terminated (cancelled) or suspended, the unemployment benefit is also terminated or suspended.

  In case the recipient of the unemployment benefit dies, the benefit belonging to him until the day of his death is paid out to his inheritor, providing inheritance documents.

The unemployment benefit payments are paid only to the persons having the unemployed person’s status (this status is granted by the decision of the employment service), therefore, the payment of this benefit is terminated, suspended and resumed whenever information is received from the employment service regarding the termination, suspension, resuming or granting of the person’s unemployed  status.

 

   The payment of cancelled unemployment benefit may be resumed if the status of unemployed person was withdrawn from a person in accordance with sub-paragraphs 1, 2, 4 and 13 of paragraph 4 of article 24 of the Law on Employment, for example, because the person got a job (for indefinite period or according to the time-defined employment contract for a period exceeding 6 months) or because the person became self-employed (for a period exceeding 6 months). The payment of cancelled unemployment benefit may be resumed only if the person re-registers in the Employment Service (the new status of unemployed person is granted) in 6 months after cancellation of payment of unemployment benefit. The payment of cancelled unemployment benefit may be resumed only once.

   If the status of unemployed person is suspended, the payment of unemployment benefit is also suspended (the status of unemployed person is suspended in the cases described in paragraph 1 of article 24 of the Law on Employment, for example, for the period, when time-defined employment relations are started for a period not exceeding 6 months or the unemployed person becomes self-employed for a period not exceeding 6 months, a person takes part in the tools of support to learning and supportive employment, performs compulsory initial military service, or the unemployed person, who is a military volunteer, other active reserve military or prepared reserve military, is summoned for exercises, training or official tasks and receives remuneration for the days of service).When the status of unemployed person is resumed after suspension, the payment of cancelled unemployment benefit is resumed (continued). In such a case, the number of resumed payments of unemployment benefit shall be unlimited.

  If you were previously paid an unemployment benefit, you may receive a re-unemployment benefit after re-registering with the Employment Service and applying for unemployment benefit only 12 months after the end of the previous unemployment benefit.

  If the fact of illegal employment is established, the person must refund the unemployment benefit for the period of illegal employment, unless the person working illegally has notified at least one of the institutions exercising control of illegal employment (for example, the State Labour Inspectorate, the State Tax Inspectorate, the Employment Service).

Who is entitled to a job search allowance?

From 1 January 2021, persons who meet the following conditions shall be eligible for job search allowance: 

  • the person has been granted unemployment status; 
  • the unemployed person does not participate in active labour market policy measures during his application for job search benefits to the Employment Service and the decision on granting this benefit; 
  • a person’s employment contract or legal relations equivalent to employment relationships expired not earlier than 3 months prior to the emergency or quarantine declared by the Government of the Republic of Lithuania;  
  • a person shall not be entitled to unemployment social insurance benefit or the period of payment thereof has expired at the time of the person’s application to the Employment Service.

 

Duration of payment of the benefit 

The job search allowance will be paid for the entire quarantine period and for a further 1 month after it ends.

 

Amount of job search benefit

  • The amount of job search allowance is 33 % the MMA in force in the month for which the job search allowance is paid. 
  • Job search allowance is EUR 211.86 per month (EUR 642 x 33 %) since January 2021. = EUR 211,86).
